当検察審査会は，上記被疑者に対する政治資金規正法違反被疑事件（東京地検平成２２年検第１１０２２号）につき，平成２２年５月２１日上記検察官がした再度の不起訴処分の当否に関し，検察審査会法第４１上の２第１項により審査を行い，次のとおり議決する。
議決の趣旨
別紙犯罪事実につき，起訴すべきである。
議決の理由
第１ 被疑事実の要旨
被疑者は，資金管理団体である陸山会の代表者であるが，真実は陸山会において平成１６年１０月に代金合計３億４２６４万円を支払い，東京都世田谷区の土地２筆（以下「本件土地」という。）を取得したのに
１ 陸山会会計責任者Ａ（以下「Ａ」という。）及びその職務を補佐するB（以下「B」という。）と共謀の上，平成１７年３月ころ，東京都選挙管理委員会において，平成１６年分の陸山会の収支報告書に，本件土地代金の支払を支出として，本件土地を資産としてそれぞれ記載しないまま，総務大臣に提出した
２ Ａ及びその職務を補佐するＣ（以下「C」という。）と共謀の上，平成１８年３月ころ，東京都選挙管理委員会において，平成１７年分の陸山会の収支報告書に，本件土地代金分過大の４億１５２５万４２４３円を事務所費として支出した旨，資産として本件土地を平成１７年１月７日に取得した旨それぞれ虚偽の記入をした上，総務大臣に提出した
ものである。
第２ 検察官の再度の不起訴処分
嫌疑不十分
第３ 検察審査会の判断
１ 再捜査について
検察官は再捜査において，被疑者，A，Ｂ，Ｃを再度取調べているが，いずれも形式的な取調べの域を出ておらず，本件を解明するために，十分な再捜査が行われたとは言い難い。
２ Ｂ供述の信用性
（１） Bの供述について，４億円の出所や土地取得資金の記載を翌年にずらした偽装工作の動機に関する供述に不合理・不自然な点もみられるが，４億円の出所，偽装工作の動機に関する供述は真の動機を明らかにできないことから，苦し紛れの説明をせざるを得なかったもので，犠飛車に報告・相談等したことに関する供述とは局面を異にする。そして，Ｂは被疑者を尊敬し，師として仰いでおり，Ｂが被疑者の関与を実際より強める方向で虚偽の供述に及ぶことや被疑者を罪に陥れるための虚偽の供述をすることはおよそ考え難い。
さらに，再捜査において，検察官から被疑者に不利となる報告・相談等を認める供述をした理由を聞かれ，合理的に説明し再捜査前の供述を維持していることなどから，前記Ｂの供述には信用性が認められる。
（２）Ｂの被疑者に報告・相談等したとの供述について，被疑者の了解を得たとする場面での具体的なやりとりがなく，迫真性があるものとまで言えないとして，また，Ｂの説明に対する被疑者の反応も受身のものであるとして，Ｂの供述の信用性を消極的に評価することは適切ではない。Ｂが取調べを受けたのは，被疑者に説明・相談し，了承を得た時から５年ほど経緯した時点である上，Bにとって，日常的な業務の場所である被疑者事務所で，用意した資料に基づいて報告・説明したのであるから，そのときのやりとりや状況に特に記憶に残るものがなかったとして，何ら不自然，不合理ではなく，本件では，細やかな事項や情景が浮かぶようないわゆる具体的，迫真的な供述がなされている方が，むしろ作為性を感じ，違和感を覚えることになるものと思われる。
３ Ｃ供述の信用性
Ｃは，「平成１７年分の収支報告書を提出する前に，被疑者に土地代金を計上することを報告し，了承を得た」旨の供述をしていたが，再捜査において，この供述を翻し，これを完全に否定するに至っている。
（１） Ｃの被疑者に報告し了承を得たとの供述に着いて，Bからの会計補助事務の引き継ぎにおいて，本件土地代金の収支報告書での処理に関する方針についても引き継ぎがなされていることは，Ｂの供述と符号するものである。そして，ＣもＢと同様に，被疑者を尊敬し，師として仰いでおり，Ｃが被疑者の関与を実際より強める方向で虚偽の供述に及ぶことや被疑者を罪に陥れるための虚偽の供述をすることはおよそ考え難いことなどから，Ｃの変遷前の供述には信用性が認められる。
（２） Ｃの供述について，Ｂの供述と同様に，被疑者の了解を得たとする場面での具体的なやりとりがなく，迫真性があるものとまで言えないとして，また，Ｃの説明に対する被疑者の反応も受身のものであるとして，Ｃの供述の信用性を消極的に評価することは適切ではない。その理由は既にＢの供述について述べたとおりである。
（３） Ｃは，再捜査において，被疑者に報告し了解を得た供述を翻し，これを否定しているが，その理由として，Ｃは，前供述当時から明確な記憶があったわけではなく，曖昧な記憶に基づいて話してしまったが，冷静になって記憶を呼び戻した結果，はっきりなかったと思い至ったというほかない旨の説明をしているが，Ｃは逮捕前から，Ａへの報告を否定しつつ，被疑者への報告，了承を供述しており，記憶に従って供述していたことが認められることから，不合理な説明である。そして，再捜査における取調べにおいては自らの供述が被疑者の刑事処分に影響を及ぼしかねないことをおそれていることが明らかであることなどから，Ｃの変遷後の供述は信用できない。
４ 被疑者供述の信用性
（１）被疑者の本件土地購入資金４億円の出所について，被疑者の当初の説明は著しく不合理なものであって，到底信用することができないものである上，その後，その説明を変えているが，変更後の説明も著しく不合理なものであって，到底信用することができないものである。被疑者が本件４億円の出所について明らかに使用としないことは，被疑者に収支報告書の不記載，虚偽記入に係る動機があったことを示している。
（２） 被疑者は，本件土地購入の原資を偽装するために，銀行から陸山会の定期預金４億円を担保に被疑者個人が４億円を借り入れるに際して，融資申込書や約束手形に署名・押印したことに関し，「Ｂから特に説明を受けることなく，求められるままに署名した」旨の供述をしている。しかし，被疑者は，本件土地購入資金として４億円を自己の手持資金から出したと供述しており，そうであれば，本件土地購入資金として銀行から４億円を借入れる必要は全くなかったわけであるから，年間約４５０万円もの金利負担を伴う４億円もの債務負担行為の趣旨・目的を理解しないまま，その融資申込書や約束手形に署名・押印したとの点については，極めて不合理・不自然である。また，本件土地購入資金の原資を隠すために偽装工作として，４億円の銀行借入を行ったのであれば，原資の４億円については収支報告書に記載されないことになり，その偽装工作のために収支報告書の不記載・虚偽記入がなされることは当然であって，このような銀行借入を行うことを了承して自ら融資申込書等に署名・押印している以上，当然に不記載・虚偽記入についても了承していたものと認められることになる。
５ 状況証拠
前記の定期預金担保貸付が行われた際に，被疑者が融資申込書や約束手形に署名・押印していることのほか，４月２７日付け検察審査会議決において指摘されているように，平成１６年１０月２９日に売買代金を支払い取得した土地の本登記を平成１７年１月７日にずらすための合意書を取り交わし，合意書どおりに本登記手続を同年１月７日に行うなど，土地取得の経緯や資金についてマスコミなどに追及されないようにするための偽装工作をしている。また，被疑者とＢ，Ａ，Ｃの間には強い上下関係があり，被疑者に無断でＢ，Ａ，Ｃが隠蔽工作をする必要も理由もない。
さらに，被疑者は，平成１９年２月２０日に事務所費や資産等を公開するための記者会見を開くにあたり，同年２月中旬ころ，Ｃに指示し，本件土地の所有権移転登記が被疑者個人の名義になっていることから，本件土地が被疑者個人の財産ではなく，陸山会の財産である旨の確認書を平成１７年１月７日付けで作成させ，記者会見の場において，被疑者自らこの偽装した確認書を示して説明を行っている。この確認書の作成年月日の偽装は事後的なものであるが，収支報告書の不記載・虚偽記入についての被疑者の関与を強く窺わせるものである。
６ まとめ
以上の直接証拠及び状況証拠に照らし，検察官が，被疑者とＡやＢ，Ｃとの共謀を認めるに足りる証拠が存するとは言い難く，結局，本件は嫌疑不十分に帰するとして，不起訴処分としたことに疑問がある。
検察官は，起訴するためには，的確な証拠により有罪判決を得られる高度の見込みがあること，すなわち，刑事裁判において合理的な疑いの余地がない証明ができるだけの証拠が必要になると説明しているが，検察官が説明した起訴基準に照らしても，本件において嫌疑不十分として不起訴処分とした検察官の判断は首肯し難い。
検察審査会の制度は，有罪の可能性があるのに，検察官だけの判断で有罪になる高度の見込みがないと思って起訴しないのは不当であり，国民は裁判所によってほんとうに無罪なのかそれとも有罪なのかを判断してもらう権利があるという考えに基づくものである。そして，嫌疑不十分として検察官が起訴を躊躇した場合に，いわば国民の責任において，公正な刑事裁判の法廷で黒白をつけようとする制度であると考えられる。
よって，上記趣旨のとおり議決する。

被疑者は，資金管理団体である陸山会の代表者，Ａは，被疑者の資金管理団体である陸山会の会計責任者であった物，Ｂ及びＣは，陸山会の会計責任者の職務を補佐していた者であるが，被疑者は，
第１ Ｂ及びＡと共謀の上，平成１７年３月３１日ころ，東京都新宿区西新宿２丁目８番１号所在の東京都選挙管理委員会において，陸山会が，平成１６年１０月初めころから同月２７日ころまでの間に，被疑者から合計４億円の借入れをしたのに，平成１６年分の収支報告書にこれらを収入として記載せず，同収支報告書の「本年の収入額」欄に，過小の５億８００２万４６４５円であった旨の虚偽を記入し，更に，陸山会が，平成１６年１０月５日及び同月２９日，土地取得費用等として合計３億５２６１万６７８８円を支払ったのに，同収支報告書にこれらを支出として記載せず，同収支報告書の「支出総額」欄に，真実の「支出総額」が４億７３８１万９５１９円であったのに３億５２６１万６７８８円過小の１億２１２０万２７３１円であった旨の虚偽を記入し，また，同月２９日，東京都世田谷区の土地２筆を取得したのに，同収支報告書にこれを資産として記載せずして，同収支報告書を総務大臣に提出した
第２ Ｃ及びＡと共謀の上，平成１８年３月２８日ころ，前記東京都選挙管理委員会において，真実は，陸山会が，平成１７年１月７日に土地取得費用等として合計３億５２６１万６７８８円を支払っていないのに，平成１７年分の収支報告書にこれらを支出として記載して，「支出総額」欄に，真実の「支出総額」が３億２７３４万７４０１円であったのに，３億５２６１万６７８８円過大の６億７９９６万４１８９円であった旨の虚偽を記入し，また，同収支報告書に東京都世田谷区の土地を資産として記載し，「資産等の内訳」欄に，真実の取得が平成１６年１０月２９日であったのに平成１７年１月７日に取得した旨の虚偽を記入して，同収支報告書を総務大臣に提出した
