今月11日に予定されている「11.11反原発1000000人大占拠」。その集合場所として日比谷公園を予定しているのですが、東京都がその使用を認めず、開催が危ぶまれています。
この「大占拠」は、毎週金曜日に首相官邸や国会前で抗議活動を行っている「首都圏反原発連合（反原連）」の主催。予定では、日比谷公園を出発して周辺をデモ行進した後、国会包囲など永田町・霞が関一帯を「オキュパイ」するというものです。今年3月と7月にも日比谷公園を出発地点として同じ趣旨のデモを行っています。
そのときと同様に公園の指定管理者に相談すると「8月に都から『やるな』と言われた」とのこと。確かに8月から手続き規則が変わりましたが、嫌がらせ以外の何物でもありません。公園はその名の通り「公」のものであり、集会の自由は憲法21条で保障されています。それを制限しようとは、民主主義を標榜する国とは思えない出来事です。
反原連は東京地裁に使用許可の仮義務付けを申し立てましたが、2日に却下。東京高裁に即時抗告し、現在係属中です。代理人の小島延夫弁護士は地裁段階で「普通に考えれば却下はありえない。ただ、政治的なことが絡むと何が起こるか分からない」と語っていましたが、本当にその通りになってしまいました。今後も予断を許しません。
